D6 SUSPENSIONS, JUDGMENTS, TRAFFIC FINES, RESTITUTION ORDERS,FINES OR COURT COSTS

Court costs increase in Florida every year. Some felonies now have court costs that exceed $1,000.00 For example, a $50,000 fine is mandated in some drug cases! In other misdemeanor cases like prostitution Section 796.07 (6), Florida Statutes, mandates a $5,000 civil penalty!

If you have probation costs on top of all the fees and costs, it can seem like an impossible burden to get out of the cycle. But it gets worse. These fines can then turn into criminal traffic charges!

If a judgment is entered against you for fines, fees, costs or restitution, the Clerk of Court will send the judgment to a collection agency. These collection agencies may charge 40% of the balance owed! (Collections

Also, the Clerk of Court may suspend your license in order for you to pay the obligation.

COLLECTION COURTS ARE MODERN DAY DEBTOR’S PRISON

Some counties realized that the costs are just too great for some to pay immediately and set up collection courts. These courts allow you to consolidate all of your obligations in that jurisdiction to be paid at a reduced monthly rate. However, you must strictly comply with the court order. A failure to pay just one $10.00 payment may result in a $210.00 Writ of Bodily Attachment. Again, your driver’s license may be suspended. (Cost Reduced to Judgment)

THE MAZE OF DRIVER’S LICENSE SUSPENSIONS

I am frequently asked to help clients in this area. This is one of the most confusing issues for Floridians and cannot be handled by the Office of the Public Defender or the vast majority of criminal attorneys. Even though you are willing to address the problem, many attorneys will not invest the time and effort necessary to help you through this confusing maze!

SO WHAT IS A D6 SUSPENSION?

A D6 suspension occurs when someone fails to abide or comply with court’s requirement on traffic ticket. There are many ways someone could do this and have their license suspended.

The most common way is failing to pay a traffic ticket. This often occurs when someone receives a traffic ticket as part of a criminal charge and they end up going to jail. Many attorneys forget to merge the ticket with the criminal case, leaving you to think the situation is over. Years later, you quickly realize that your license is suspended because of a previously unpaid ticket. It’s very unfortunate situation, because you are unable to get work and pay the large fines associated with a D6 suspension.

The second way for people to suffer a D6 suspension occurs when someone fails to appear for traffic summons. This occurs when individuals do not appear when they receive a summons for traffic court after they have requested a hearing or hearing is in place for them for their ticket. This also unfortunate because people generally are not aware of the D6 suspension until they receive a traffic citation and/or arrest for driving with a license suspended or revoked.

The third way drivers receive D6 suspensions concerns when Florida drivers elect to complete traffic or DUI school and they fail to complete it. This often occurs with driving under the influence cases or speeding tickets.  Again, this is very unfortunate because these people also only realize they’ve received a D6 cancellation after they have been charged with driving with license suspended or revoked. Beware!

It’s worth noting that if someone is adjudicated of three charges of driving while license suspended or revoked, it could result in a third degree felony, with a maximum of five years prison in Florida. As I have told countless clients, of all the ways to become a convicted felon Florida, felony driving while license suspended or revoked is arguably the worst. A convicted felon will lose their ability to possess firearm, vote and are subjected to many other penalties and hardships.
