What to Expect When Facing Criminal Charges in Florida

Being arrested or investigated is overwhelming — but knowing what to expect can help you stay in control. Here’s how the process typically unfolds, and how Fayard Law helps at each step.

The Criminal Process from Arrest to Trial

After an arrest, the prosecution may formally file charges. The case proceeds through arraignment, pre-trial motions, and potentially trial. Throughout this process, your attorney will advocate for reduced charges, dismissals, or alternative resolutions like diversion programs.

Your Rights During a Criminal Investigation

You have the right to remain silent, the right to legal counsel, and the right to due process. Never speak to law enforcement without a lawyer present. At Fayard Law, we protect your constitutional rights from day one to prevent self-incrimination or procedural violations.

Common Mistakes
to Avoid

Many clients make costly mistakes, like talking to police, ignoring court dates, or posting about the case online. One of the most damaging errors is waiting too long to hire a qualified criminal defense attorney. Early intervention can make a big difference.

How a Defense Lawyer
Can Help

An experienced criminal defense lawyer can investigate the facts, identify weaknesses in the prosecution’s case, negotiate favorable outcomes, and if necessary, fight at trial. Having a skilled attorney like Michael Fayard gives you an advocate who knows the law and the local courts.

Frequently Asked Questions About Criminal Defense

Choosing a criminal defense lawyer and understanding your case can be confusing. Here are answers to some of the most common questions asked by clients in Sarasota.

Do I Really Need a Criminal Defense Lawyer?

Yes. Even minor charges can result in fines, jail time, or a criminal record. A qualified lawyer helps protect your rights, explores legal defenses, and works to minimize or eliminate penalties. Going it alone could cost you far more in the long run.

What’s the Difference Between a Felony and Misdemeanor?

A misdemeanor is considered a less serious offense, typically punishable by less than one year in jail. Felonies are more serious and can result in long prison terms and major fines. The consequences of a felony conviction often include loss of civil rights and long-term life impact.

What Should I Do If I’ve Been Arrested?

Stay calm, exercise your right to remain silent, and request an attorney. Don’t answer questions or make statements to law enforcement until you have legal representation. Contact Fayard Law as soon as possible so we can begin protecting your rights immediately.

Can Charges Be Reduced or Dismissed?

In many cases, yes. Depending on the circumstances, charges may be reduced, dismissed entirely, or resolved through a plea deal or diversion program. An experienced lawyer will evaluate the evidence, file appropriate motions, and negotiate aggressively on your behalf.
